TERMS OF SERVICEMontañoWeb agrees to provide services to the Subscriber, subject to the following TOS (Terms of Service). From hence forth in this TOS the usage of "us", "we", "our", "ours" shall constitute reference to MontañoWeb, the usage of "you", "your", "they", "them" shall refer to client of MontañoWeb. Use of MontañoWeb services constitutes acceptance and agreement to the company's TOS (Terms of Service). All provisions of this contract are subject to the TOS (Terms of Service). The TOS may be changed from time to time at the discretion of MontañoWeb. Subscriber understands that changes to the TOS by us shall not be grounds for early contract termination or non-payment.
Disclosure : The TOS specifically prohibits the use of our service for illegal activities. Therefore, Subscriber agrees that MontañoWeb may disclose any and all subscriber information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification to the Subscriber.
Email (Spam) : Spamming, or the sending of unsolicited email, from a MontañoWeb hosted server is STRICTLY prohibited and will qualify your site for immediate deactivation with no refund. Server Abuse : Any attempts to harm any MontañoWeb hosted server or customer of ours is strictly prohibited. MontañoWeb holds no responsibility for the use of our clients' accounts. Any account that abuses server resources is cause for immediate de-activation without any refund of payments made. Any site using what we deem to be excessive cpu cycles or any resources that cause strain to other sites may also be offered new terms.
Account Backups: While our backup systems are state-of-the-art, we can not guarantee the backups. We encourage our clients to keep up to date copies of their sites locally, and to download an instant backup from their control panel.
Contact & Billing Information : You must provide us with, and keep current, good contact information. E-mail and telephone contacts are required. Your control panel has a link at the top of the main page that allows you to update all contact information.
Billing & Fees : Payments are due on the anniversary date of the month for that month's service. Accounts not paid by due date are subject to a $5 late fee. Service will be interrupted on accounts that reach 5 days past due. Service interrupted for nonpayment will be charged a $10 reconnect fee. Service will be terminated on accounts that reach 10 days past due. If any terms or conditions are not followed, the account in question will be automatically deactivated. All credit card accounts are to be automatically billed on their anniversary date, unless otherwise requested by the client.
Refunds : 100%, NO QUESTIONS ASKED within the first 7 days of service. After 7 days, all payments are NON-REFUNDABLE!
7 Day Guarantee : All accounts are entitled to a 7 day money back guarantee. This guarantee begins the day we send out your account login details. Should your account be suspended/cancelled by our staff due to client/server abuse, over-use of allocated resources or fraud, this guarantee is void. If the client violates our terms of service (TOS) this guarantee is void.
Cancellation : All cancellations must be sent to Support@MontanoWeb.com. There is no cancellation fee. You must cancel at least 7 days prior to your next billing cycle. Payments made up to your cancellation date are not refundable unless you're canceling within the 7 day guarantee period . We reserve the right to remove any account without notice, for any reason at any time.
Liability & Warranty : We are not responsible for any damages your business may suffer. We do not make implied or written warranties for any of our services. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by us. The client acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, client agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company. You further acknowledge that the company's liability for its own negligence may not in any event exceed an amount equivalent to charges payable by the client for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss or injury.
We reserve the right to refuse, cancel, or suspend service at our sole discretion.
